Montana Requests Implementation Delay of Drug Formulary for Legacy Claims

The Montana Department of Labor and Industry is asking insurers and employers to delay the application of the drug formulary for legacy claims until after the COVID-19 crisis has passed.

The Montana drug formulary was effective for all new claims on April 1, 2019. The formulary should still be applied to new claims. Legacy claims (claims with dates of injury prior to April 1, 2019) were regulatorily mandated to be subject to the drug formulary on April 1, 2020. The Department is making this request to relieve treating physicians of any undue complexity during this crisis.

The request does not have the force of rule or law. Insurers are being asked to voluntarily comply with the request. Please work with your Mitchell ScriptAdvisor client services manager if you would like to participate with this voluntary request.
